General Terms and Conditions
Below you will find the general terms and conditions that you can use for your webshop. Please note: No rights can be derived from these terms and conditions. If you have any doubts about the content, consult a legal expert.
Article 1 – Definitions
In these terms and conditions, the following definitions apply:

Cooling-off period: The period during which the consumer can exercise their right of withdrawal.

Consumer: The natural person who does not act in the exercise of a profession or business and enters into a distance contract with the entrepreneur.

Day: Calendar day.

Continuous transaction: A distance contract relating to a series of products and/or services, for which the delivery and/or purchase obligation is spread over time.

Durable data carrier: Any means that allows the consumer or entrepreneur to store information addressed to them personally in a way that enables future consultation and unchanged reproduction of the stored information.

Right of withdrawal: The possibility for the consumer to withdraw from the distance contract within the cooling-off period.

Entrepreneur: The natural or legal person who offers products and/or services remotely to consumers.

Distance contract: A contract concluded within the framework of an organized system for distance selling of products and/or services, where only one or more means of distance communication are used up to and including the conclusion of the contract.

Means of distance communication: A method that can be used to conclude a contract without the consumer and entrepreneur being physically present in the same place at the same time.

Article 3 – Applicability

These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.

Before concluding a distance contract, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated before the contract is concluded that the terms and conditions are available for review at the entrepreneur’s premises and will be sent free of charge upon request.

If the contract is concluded electronically, the text of these general terms and conditions may be provided electronically in such a way that the consumer can easily store it on a durable data carrier. If this is not reasonably possible, it will be indicated where the general terms and conditions can be accessed electronically and that they will be sent electronically or by other means free of charge upon request.

If specific product or service conditions apply in addition to these general terms and conditions, the consumer can always rely on the most favorable applicable provision in case of conflicting conditions.
Article 4 – The Offer

If an offer has a limited validity period or is subject to conditions, this will be explicitly stated in the offer.

The offer is non-binding. The entrepreneur is entitled to modify and adjust the offer.

The offer contains a complete and accurate description of the offered products and/or services. The description is sufficiently detailed to enable a proper assessment of the offer by the consumer.
Article 5 – The Agreement

The contract is established when the consumer accepts the offer and meets the stipulated conditions.

If the consumer has accepted the offer electronically, the entrepreneur will confirm receipt of the acceptance immediately by electronic means.

The entrepreneur may investigate whether the consumer can fulfill their payment obligations and refuse an order if there are justified reasons.
Article 6 – Right of Withdrawal

The consumer has the right to withdraw from the contract without giving any reason within 14 days from the day of receipt of the product.

The consumer must notify the entrepreneur of their wish to withdraw within 14 days of receiving the product via written communication (e.g., email). They must then return the product within 14 days after this notification.
Article 7 – Costs in Case of Withdrawal

If the consumer exercises their right of withdrawal, they are responsible for the return shipping costs.

If the consumer has already made a payment, the entrepreneur will refund the amount within 14 days of receiving the returned product.
Article 8 – Exclusion of Right of Withdrawal

The entrepreneur may exclude the right of withdrawal for certain products, such as custom-made items, perishable goods, and hygiene products where the seal has been broken.
Article 9 – Prices

The prices of the offered products and/or services will not increase during the validity period of the offer, except for price changes due to VAT adjustments.
Article 10 – Conformity and Warranty

The entrepreneur ensures that the products and/or services comply with the contract, specifications, and reasonable usability.

Any defects must be reported within 14 days after receipt.
Article 11 – Delivery and Execution

The entrepreneur will take the utmost care in receiving and executing product orders.

The delivery address is the one provided by the consumer.

If delivery is delayed, the consumer will be informed within 30 days, and they have the right to cancel the contract.
Article 12 – Duration Transactions: Termination and Renewal

Consumers can cancel an indefinite-term contract at any time with a notice period of no more than one month.

Fixed-term contracts cannot be automatically renewed without the consumer’s consent.
Article 13 – Payment

The amounts due by the consumer must be paid within 7 business days unless otherwise agreed.
Article 14 – Complaints

Complaints must be submitted within 7 days after discovering the defect.

Complaints will be responded to within 14 days.
Article 15 – Disputes
-
Agreements between the entrepreneur and the consumer are exclusively governed by Dutch law, even if the consumer resides abroad.
